1. Definitions

Within the meaning of these terms of sale, the term...

Buyer: individual acquiring products through the site.
Seller: Wad, Patrick Deegbe, Av. C. F. Ramuz 101, CH-1009 Pully
Website: Seller's website on which customers can place an order for products.
Product: all the products that the seller can sell on his website: dried fruits, ginger drink, juices...
Order: product ordered by the client to the seller from its site.

2. Scope

These general conditions of sale apply to all orders for products sold by the seller on his website. The general conditions of sale are available on the website and accepted by the customer before placing any order.
They are applicable in their entirety for any order placed on the seller’s website and its customers in Switzerland, regardless of the place of order and / or delivery.
The seller and the client agree that these terms of sale exclusively govern their relationship.

3. Order

The buyer declares having read the conditions before placing the order and acknowledges that the validation of the order implies acceptance of their terms.
Any order on the site takes into consideration, payment obligation and acceptance of the prices and descriptions of products available for sale.
In some cases, particularly non-payment, incorrect address or other problem on the client's account, the seller reserves the right to block the customer's order until the problem is resolved.
In case of unavailability of the product ordered, the customer will be informed by email. The cancellation of the order of this product and its potential refund will then be made.

4. Products information

The products covered by these general conditions of sale are those listed on the seller's website and are listed as sold and shipped by the seller. They are offered subject to availability.
Products are described and presented with the greatest possible accuracy. However, if errors or omissions have occurred in this presentation, the seller's responsibility could not be committed.

5. Price

The prices indicated on the site correspond to prices including taxes, excluding logistical preparation and shipping. The seller reserves the right to change prices for products displayed on the site. However, the products will be charged to the buyer on the basis of rates indicated at time of validation of the order.

6. Mode of payment

The seller reserves the right to suspend any standing order and delivery in case of refusal to authorize payment by client bank to certified financial institution or in case of nonpayment. Seller specifically reserves the right to refuse delivery or to deliver an order from a customer who has not fully paid or whose previous order has an ongoing payment dispute.

7. Availability of product – refund

Except in cases of force majeure or during periods of closure of the online shop which will be clearly announced on the home page of the site, the shipping time will be limited to the available stocks, as indicated below. Delivery time starts from the date on the order confirmation the client receives by email.
After receiving your payment, Wad, will ship your order by post within 5 days.
In case of contractual noncompliance deadlines, the buyer may terminate the contract by sending a registered letter with acknowledgment of receipt. In this case, the seller must refund the customer the full amount paid at the latest within 15 days of the date the contract was terminated.
In case of unavailability of the product ordered, the customer will be informed at the earliest and will have the opportunity to cancel the order. The customer then has the option of requesting either a refund of amounts paid, or takes another product.

8. Methods of delivery

The delivery is made after confirmation of payment by the Seller banking organization.
The products are delivered to the address given by the buyer when ordering. The customer must ensure its accuracy. Every parcel returned to the seller because of an incorrect or incomplete shipping address will be returned at the customer’s expense.

The seller undertakes to deliver the goods with your order (quantity, product).

9. Complains

The customer must make to the seller any claim of non-compliance or defect of goods in kind or in quality.

10. Guarantee

If the product received by the buyer does not conform to the product designated in the order, the product will be replaced or refunded, depending on the wishes of the buyer.

11. Force majeure

All circumstances beyond the control of the parties preventing the execution under normal conditions of their obligation are regarded as grounds for exemption from the obligations of the parties and cause for suspension of their obligation.
The party invoking the above mentioned circumstances must immediately notify the other party of their occurrence and their disappearance.
Will be considered as force majeure all compelling facts or circumstances, outside parties, unpredictable, inevitable, independent of the will of the parties and which cannot be prevented by them, despite all efforts reasonably possible. Explicitly, are considered as force majeure or unforeseeable circumstances beyond those usually retained by the jurisprudence of French courts and tribunals: the grove of the means of transportation or supplies, earthquakes, fires, storms, floods, lightning, stop of telecommunication networks or difficulties specific to telecommunication networks to the customers.
The parties will examine the impact of the event and agree the conditions under which the contract will be continued.

12. Data protection

All personal data we collected are treated with the strictest confidentiality. During your purchase only the information that is really needed is requested for. We do not sell, use as a business or rent this information to others. We can however exceptionally decide to communicate certain information that is directly linked with your purchase that is needed to execute your purchase in line with our sales contract that you have adhere to.

The failure of either party not to claim a breach by the other party to any obligations contained in these terms and conditions shall be construed in the future as a waiver 'obligation.
